Inspection fee: _____________. The inspection fee is due at the time of the inspection. If the client is not present at the inspection, the fee is due upon receipt of the report. Acceptance of this report shows acceptance of this agreement, in the event report is not signed by client. The above fee does not include charges for court appearances to give testimony. If required a separate fee for court appearances must be negotiated.
Independent Contractor Status: Both Client and Terry Green Home Inspections hereby agree and acknowledge the Inspector's status is that of an independent contractor for Client. Under no circumstances is it intended that Terry Green Home Inspections shall be considered an agent, servant, or employee of the Client. Terry Green Home Inspections shall control the manner and method of any inspection undertaken.
Scope of the Inspection: Inspect and report on the site, exterior, foundation, garage, attic, roof system, plumbing, electrical, heating, air conditioning, kitchen, bathrooms, and interior. Report covers the general condition of visible portions of the main structure on the property as of the inspection date. The inspection does not involve dismantling or removing any objects. Latent and concealed defects are excluded. Inspection and report is not a warranty, guarantee, or insurance policy or substitute for any disclosure statement, whether or not it is required by law. No representation is made about how long any feature will continue to function. Inspection covers only real property.
Items Excluded: Detached buildings (except parking structure), concealed or inaccessible features, termites/other pests, any form of engineering analysis/opinions, complex systems such as self-cleaning ovens, heat exchangers, radiant heating elements, alarm/fire detection systems, automatic timers, elevators, dumbwaiters, satellite dishes. Also excluded are low voltage systems, property land survey, building code analysis as it relates to the property, environmental hazards, notification of product recall, private water of sewer systems, building or property appraisals, determination of life expectancy, or cost estimates for corrective work. Excluded also are swimming pool, hot tubs/spas, ponds, fountains, etc. Also cosmetic finishes and conditions, landscape and foliage, noise transmission, determination of odors. Also excluded are unique features with which the inspector is unfamiliar, or which has been marked as not inspected on the report. Requirements of Americans with disability Act is excluded. Excludes any system or component which is shut down. Inspector will not light pilots or start systems.
Limits of Liability: Terry Green Home Inspections/Inspector (s) liability is limited to the price paid for said inspection, and shall in no event include special or consequential damages, including profits (or profits lost). This liability is binding upon the client as well as relatives and heirs. Client hereby voluntarily releases, forever discharges and agrees to hold harmless and indemnify Terry Green Home Inspections and any or all of its agents from any and all liability, claims, demands, actions, or rights of action, which are related to, arise out of, or in any way connected with the inspection contracted for, including those attributed to the negligent acts or omissions of Terry Green Home Inspections.
Dispute Resolution: In the event of complaints against Terry Green Home Inspections/Inspector, client shall provide reasonable notice, and allow an inspection of the disputed conditions, and allow inspector to submit a new inspection report. Arbitration shall be the method used for settlement of claims that can not be agreed upon by the parties.
Statute of limitations: If a claim for a defect in the report is not given to Terry Green Home Inspections , in writing, within _________ (normally 90 days) of the date of the inspection, all defects will be deemed to be waived.
Confidentiality of Report: Report is for the exclusive use of client. Client will be furnished additional copies of this report for distribution to their agent and to the property owner. Use of all disclosure in the report is restricted to the transaction for which the inspection was performed. Report is not to be copied or distributed to any other party without the consent of Terry Green Home Inspections. Third parties (those not a party to the signing of this agreement) are advised to secure their own independent inspection, and not to rely on the results of this inspection for decisions regarding the home.
